User Agreement

This User Agreement ("Agreement") is entered into between you ("User," "you," or "your") and StayGowe21 ("Company," "we," "us," or "our") and governs your use of the StayGowe21 freelance marketplace platform.
1. AGREEMENT TO TERMS
By creating an account, you agree to:

2. ACCOUNT CREATION AND RESPONSIBILITIES
2.1 Eligibility
To create an account, you must:
- Be at least 18 years old
- Have the legal capacity to enter contracts
- Not be prohibited from using our services under applicable laws
- Not have been previously banned from the platform
2.2 Account Information
You agree to:
- Provide accurate and complete information
- Keep your information updated
- Not share your account credentials
- Immediately notify us of unauthorized access
- Be responsible for all activity under your account
2.3 Identity Verification
We may require:
- Government-issued ID verification
- Phone number verification
- Address verification
- Professional credential verification
- Background checks (for certain services)
3. USER ROLES AND RESPONSIBILITIES
3.1 As a Freelancer
#### You May:
- Create a professional profile
- Apply for available projects
- Offer services within legal boundaries
- Set your own rates
- Accept or decline projects
- Build your portfolio
- Receive payments through the platform
#### You Must:
- Accurately represent your skills and experience
- Deliver work as agreed
- Communicate professionally
- Meet agreed deadlines
- Maintain confidentiality
- Pay applicable taxes
- Not plagiarize or infringe on intellectual property
#### You Must Not:
- Misrepresent your qualifications
- Outsource work without client consent
- Solicit off-platform payments
- Share client confidential information
- Engage in price manipulation
- Create fake reviews or testimonials
3.2 As a Client
#### You May:
- Post job opportunities
- Review freelancer profiles and proposals
- Select freelancers for projects
- Request revisions per agreement
- Leave honest reviews
- Dispute unsatisfactory work
#### You Must:
- Provide clear project requirements
- Pay for completed work
- Release payments promptly
- Communicate professionally
- Respect freelancer intellectual property
- Provide necessary resources for project completion
#### You Must Not:
- Request illegal or unethical services
- Discriminate against freelancers
- Post fake jobs
- Solicit free work
- Share freelancer confidential information
- Circumvent platform fees
4. PLATFORM USAGE RULES
4.1 Acceptable Use
The platform may be used for:
- Professional service exchanges
- Portfolio showcasing
- Professional networking
- Skill development
- Community discussions
4.2 Prohibited Activities
You may not:
- Violate any laws or regulations
- Harass, threaten, or abuse others
- Post offensive or inappropriate content
- Spam or send bulk unsolicited messages
- Use bots or automation without permission
- Attempt to hack or compromise security
- Scrape data or content
- Create multiple accounts to manipulate the system
- Engage in money laundering
- Use the platform for illegal services
5. PAYMENT TERMS
5.1 Payment Processing
- All payments must go through StayGowe21's payment system
- We use third-party payment processors
- Payments are held in escrow until work approval
- Platform fees apply to all transactions
5.2 Fee Structure
#### For Freelancers:
- No platform fees — freelancers keep 100% of their earnings
- Standard payment processing fees may apply to payouts
#### For Clients:
- Standard payment processing fees apply to transactions
- Optional premium features available through subscription plans
5.3 Payment Disputes
- Disputes must be raised within 30 days
- We provide mediation services
- Our decision on disputes is final
- Chargebacks may result in account suspension
6. INTELLECTUAL PROPERTY
6.1 Your Content
You retain ownership of content you create, but grant us license to:
- Display it on the platform
- Use it for promotional purposes (with consent)
- Store and transmit it through our services
6.2 Work Product
Unless otherwise agreed:
- Freelancers retain rights until full payment
- Upon payment, rights transfer to client
- Custom agreements override default terms
6.3 Platform Content
All StayGowe21 content, including but not limited to:
- Logo and branding
- Website design and layout
- Platform features and functionality
- Documentation and guides
Are owned by StayGowe21 and protected by intellectual property laws.
7. COMMUNICATION GUIDELINES
7.1 Professional Standards
All communications must be:
- Professional and respectful
- Relevant to projects or platform use
- Free from discriminatory language
- Free from threats or harassment
7.2 Monitoring
We may monitor communications to:
- Ensure compliance with terms
- Prevent fraud
- Resolve disputes
- Improve services
8. REVIEWS AND FEEDBACK
8.1 Review System
- Both parties can leave reviews after project completion
- Reviews must be honest and factual
- Reviews cannot be altered after 14 days
- Fake reviews result in account termination
8.2 Feedback Rights
By leaving reviews, you grant us the right to:
- Display them publicly
- Use them for marketing
- Share them with third parties
9. SUBSCRIPTION SERVICES
9.1 Subscription Plans
We offer the following subscription options:
- Free: Core platform features with usage limits
- Pro: $39.99/month — unlimited access to all features, AI-powered tools, priority support, and a 7-day free trial
9.2 Billing and Cancellation
- Subscriptions auto-renew
- Cancel anytime before renewal
- No refunds for partial months
- Downgrade takes effect at next billing cycle
10. DATA AND PRIVACY
10.1 Data Collection
We collect data as outlined in our Privacy Policy, including:
- Account information
- Usage data
- Communication data
- Payment information
10.2 Data Usage
Your data is used to:
- Provide and improve services
- Process transactions
- Communicate with you
- Ensure platform security
11. TERMINATION
11.1 Voluntary Termination
You may close your account at any time by:
- Completing all active projects
- Withdrawing available funds
- Submitting a closure request
11.2 Involuntary Termination
We may suspend or terminate accounts for:
- Terms violation
- Fraudulent activity
- Extended inactivity
- Legal requirements
11.3 Effect of Termination
Upon termination:
- Access to platform ceases
- Pending payments are processed
- Data retention per Privacy Policy
- Obligations for completed work remain
12. DISCLAIMERS AND LIMITATIONS
12.1 Platform Role
StayGowe21 is a marketplace facilitator. We do not:
- Employ freelancers
- Guarantee work quality
- Provide professional advice
- Assume liability for user actions
12.2 Service Availability
- Services provided "as is" and "as available"
- No guarantee of uninterrupted access
- Maintenance may cause temporary unavailability
12.3 Limitation of Liability
Our maximum liability is limited to fees paid in the past 12 months. We are not liable for:
- Lost profits or revenue
- Indirect or consequential damages
- User disputes
- Third-party actions
13. INDEMNIFICATION
You agree to indemnify StayGowe21 against claims arising from:
- Your violation of this Agreement
- Your violation of laws or third-party rights
- Content you post
- Your use of the platform
14. DISPUTE RESOLUTION
14.1 Informal Resolution
First attempt to resolve disputes through customer support.
14.2 Arbitration
Unresolved disputes subject to binding arbitration under AAA rules.
14.3 Class Action Waiver
You waive the right to participate in class actions against StayGowe21.
15. GOVERNING LAW
This Agreement is governed by Delaware law, without regard to conflict of law principles.
16. MODIFICATIONS
We may modify this Agreement with 30 days notice. Continued use constitutes acceptance.
17. SEVERABILITY
If any provision is unenforceable, the remainder continues in effect.
18. ENTIRE AGREEMENT
This Agreement, along with our other policies, constitutes the entire agreement between parties.
